Mayor Foxx nominated to be next U.S. Transportation Secretary

CHARLOTTE, NC (WBTV)- President Barack Obama nominated Charlotte Mayor Anthony Foxx to head the U.S. Department of Transportation on Monday.

The president highlighted Foxx's background on building out the transit system here in Charlotte with the Lynx Blue Line and the start of work on the city's east-west streetcar line.

Earlier this month, Foxx announced he would not seek re-election as Charlotte mayor.

"If confirmed, I will do my absolute best to uphold the standard at the Department of Transportation," Foxx said in his statement at the White House. "I don't know of a Democrat or?Republican road, bridge, rail system or port."

Mayor Foxx nor his press secretary commented on the impending announcement. But some state representatives are already taking to Twitter to congratulate Foxx on his nomination.

Several city council members say they haven't heard from the mayor officially, or unofficially, and one member said it would be inappropriate to say anything until it's official.

Mayor Pro Tem Patrick Cannon said Sunday night he was not surprised about the nomination news.

He said if the appointment goes through the hopes the council will appoint someone not currently on the council to finish out Foxx's term. The council is required by state law to pick someone of the same political party as Foxx, a Democrat.

This is one of the last few selections President Obama needs to make. Catawba College Political Science professor Dr. Michael Bitzer noted how this could possibly help quiet the critics who say Obama's cabinet lacks diversity.

"I think he has certainly gained the admiration of the President and that is probably the number one qualifier. The President needs to feel comfortable with the people on his cabinet. But issues like the street car, issues like the airport are could be something Republicans in the Senate are going to bring to question," Bitzer said.

The nomination is only part of the process.

The Senate has to confirm the appointment and so far the President's picks have been held up by Senate Republicans. It could be several weeks before things are finalized.

Reaction

U.S. Sen. Richard Burr, R-NC, issued a statement following the announcement saying that he looked forward to working with the mayor during the nominating process.

Congressman Robert Pittenger sent WBTV a statement about Foxx's nomination saying:?

"For many years, I've admired Anthony Foxx's deep commitment to his family, especially how he protects time with his children.? That will be even more important in his new role.

As Secretary of Transportation, my hope is that Mr. Foxx will prioritize funding for widening and improving major road systems, which are used by far more commuters and generate significant economic growth.?

The new airport intermodal facility is also critical to creating tens of thousands of new jobs in our region and, if confirmed, I will work with Mr. Foxx to ensure the project receives appropriate federal support."

NC Democratic Party Chairman Randy Voller says "We're proud of Mayor Foxx and we look forward to continuing our support as he works on behalf of all American families to invest in the needed infrastructure that will create jobs and opportunity in our local communities..."

U.S. Sen. John Thune, R-SD, Ranking Member of the Senate Committee on Commerce, Science, and Transportation, released the following statement after President Obama announced the nomination of Mayor Anthony Foxx to be the next Secretary of Transportation:

"I want to thank Secretary LaHood for his years of service at both the Department of Transportation and before that in Congress. He is a dedicated public servant and I wish Ray and Kathy the best. I look forward to reviewing Mayor Foxx's record and working with Chairman Rockefeller to ensure the confirmation process is fair and thorough. Without question, our nation faces a number of transportation challenges that will require strong leadership and effective communication with Congress to keep our nation moving."

Sen. Jay Rockefeller, D-WV, Tweeted: "Look forward to meeting Mayor Foxx, congratulating him on nomination as Transportation sec, discussing his vision for infrastructure needs."

City Manager Ron Carlee released the following statement: "I would like to congratulate Mayor Anthony Foxx on his nomination to become the next Secretary of Transportation. I wish him well as he goes through this confirmation process. Meanwhile, I look forward to working with him and our Council on the immediate and strategic issues facing Charlotte."

U.S. defense chief reaffirms military ties with Egypt

CAIRO (Reuters) - U.S. Defense Secretary Chuck Hagel underscored Washington's military commitment to Egypt on Wednesday and pledged American support as Egyptian forces evolve to address new and shifting security threats, U.S. defense officials said.

"I wanted to stop in Egypt to ... reaffirm American commitment to Egypt's emerging democracy, encourage the democratic and economic reforms that are underway here," Hagel told reporters after a day of meetings with Egyptian officials.

"This is a large country, an important country. They are undertaking the right course of action - human dignity and freedom and democratic norms and governance. We are committed to helping any nation that does that," he said.

After stops in Israel, Jordan and Saudi Arabia, Hagel discussed military cooperation and the civil war in Syria with President Mohamed Mursi and Defense Minister Abdel Fattah al-Sisi.

But the U.S. Congress is divided over continued aid to Cairo as the Muslim Brotherhood consolidates its grip on power.

Treasury Secretary Jack Lew did however express support on Wednesday for granting an International Monetary Fund loan to Egypt, saying it was in U.S. interests for Egypt to be on a more sustainable course.

U.S. defense officials said Hagel discussed a full range of issues with Sisi and Mursi, including the Camp David peace treaty with Israel, the security situation in the Sinai and the war in Syria. Hagel pledged U.S. support as Egypt's military grows and changes to meet new security threats.

"All militaries evolve as the threat picture changes and as they try to adapt to those threats, they are ... assessing border security, counterterrorism, non-state actors that are a threat to the state," a U.S. defense official said later.

He said the two sides did not talk about specific types of aid but agreed to continue their discussions as the Egyptian military reassesses the threats the country faces.

Egypt has received $1.5 billion a year in mostly military assistance ever since it signed the 1979 peace treaty with Israel, the first between the Jewish state and an Arab state.

Cairo has maintained a "cold peace" with Israel under the Islamist president and U.S. officials say practical security cooperation with both Washington and the Israelis is working smoothly, though political ties are frozen.

Secretary of State John Kerry said this month that the United States was increasingly worried about internal developments in Egypt, which he said was at a "tipping point".

"We share a very real concern in the Obama administration about the direction that Egypt is apparently moving in," Kerry said, citing economic problems, stalled talks on the IMF loan and the absence of dialogue with the liberal opposition.

Hagel's visit was an opportunity for Washington to maintain a dialogue with the Egyptian military, seen as a pro-American guarantor of regional stability during two years of turmoil since the overthrow of veteran U.S. ally Hosni Mubarak.

The United States is due to deliver a new batch of F-16 fighter jets to Egypt soon, diplomats said, but some Republican senators oppose the delivery. Cairo received four of a group of 20 F-16s in January and the rest are due later this year.

General James Mattis, then head of U.S. Central Command which covers the Middle East, told a Senate hearing last month: "The bottom line is ... that the Egyptian military, through a very difficult period, has maintained and even built trust with the Egyptian people."

He said the armed forces had upheld Egypt's international treaties, including with Israel, provided extra security for U.S. ships going through the Suez Canal, and helped keep the Gaza area as quiet as at any time in 10 years through quiet security operations in the Sinai Peninsula.

"I think anything right now that we do that would undercut the trust between the United States, the U.S. military and the Egyptian military would be extremely unhelpful," Mattis said.

Reese Witherspoon Apologizes For Her Behavior: Actress 'Deeply Embarrassed' After Arrest

ATLANTA ? Reese Witherspoon is "deeply embarrassed" about what she said to police officers after she and her husband were arrested during a traffic stop in Atlanta.

The Oscar-winning actress released a statement late Sunday apologizing for her behavior to police that began when her husband, Hollywood agent Jim Toth, was arrested early Friday for driving under the influence of alcohol.

"Do you know my name?" Witherspoon is quoted as saying in a state trooper's report. She also said: "You're about to find out who I am" and "You're about to be on national news," according to the report.

"I clearly had one drink too many and I am deeply embarrassed about the things I said," Witherspoon said. "It was definitely a scary situation and I was frightened for my husband, but that is no excuse. I was disrespectful to the officer who was just doing his job. The words I used that night definitely do not reflect who I am. I have nothing but respect for the police and I'm very sorry for my behavior."

Witherspoon said she can't comment further "out of respect" for the pending case, and her publicist, Meredith O'Sullivan Wasson, offered no other details.

The 37-year-old actress was arrested on a municipal charge of disorderly conduct early Friday after a state trooper said she wouldn't stay in the car while Toth was given a field sobriety test. She was released from jail after the Friday morning arrest and was in New York on Sunday night for the premiere of her new film, "Mud." She posed for cameras on the red carpet but did not stop to talk to reporters.

The trooper noticed the car driven by her husband wasn't staying in its lane early Friday morning, so he initiated a traffic stop. He reported that Toth had droopy eyelids, watery, bloodshot eyes, and his breath smelled strongly of alcohol.

Toth told the trooper he'd had a drink, which Witherspoon said was consumed at a restaurant two hours before the traffic stop, the trooper writes.

Before the field sobriety test began, Witherspoon got out of the car, was told to get back in and obeyed, the report said. After the "Walk the Line" star got out a second time, the trooper said he warned her that she would be arrested if she left the car again.

As the test continued, "Mrs. Witherspoon began to hang out the window and say that she did not believe that I was a real police officer. I told Mrs. Witherspoon to sit on her butt and be quiet," Trooper First Class J. Pyland writes.

Toth, 42, was then placed under arrest. He was charged with driving under the influence and failure to maintain the lane.

At that point, the report says, Witherspoon got out and asked the trooper what was going on. After being told to return to the car, she "stated that she was a `US Citizen' and that she was allowed to `stand on American ground,'" the report states.

The trooper then began to arrest Witherspoon. The report says Witherspoon was resistant at first but was calmed down by her husband.

Toth and Witherspoon were then taken to jail.

News of the arrest broke shortly before Witherspoon arrived on the "Mud" red carpet.

"I can't say anything because I don't know," said director Jeff Nichols. "I literally ? the first guy on the press line to say something was the first time I heard about it so I gotta go figure it out."

Matthew McConaughey, who plays the lead role in "Mud" and is represented by Toth, said "I'm not going to comment on that because it's too fresh."

Health News - Low carbohydrate diets: best for weight loss?

The low carbohydrate diet is one of the more popular diets to emerge in recent years amid increasing obesity levels in Australia ? but how effective is it when it comes to weight loss?

UniSA nutrition expert Professor Jon Buckley will examine the low-carb diet at his upcoming Knowledge Works lecture at City East Campus tomorrow (Tuesday) night.

Prof Buckley says low-carb diets do result in greater weight loss than other diets over the short term (up to six months), but beyond that the weight loss is similar to other diets.

?Previously there were concerns that low carbohydrate diets might have adverse effects on risk factors for cardiovascular disease, in particular on LDL-cholesterol (bad cholesterol), but more recent evidence suggests that this is not the case,? Prof Buckley says.

?It does appear however that this dietary pattern has greater positive effects on HDL cholesterol (good cholesterol) than typical diets. Thus, the overall effect on blood lipid profile might be better than conventional diets.?

However, Prof Buckley says there is some evidence that there may be adverse impacts on non-traditional risk factors for cardiovascular disease (that is, risk factors that are not as well recognised or accepted), adverse impacts on mood and potentially adverse effects on mortality, but the evidence in these areas is limited and not conclusive at this stage.

The Director of UniSA?s Nutritional Physiology Research Centre will outline the most-up-to-date evidence regarding the use of the low-carb diet for effective weight loss during his lecture, which will be held in the Basil Hetzel Building at City East campus tomorrow night (April 23) from 6pm to 7pm.

Undergraduate Student Government unanimously passed a resolution Tuesday that urges the administration to increase funding to improve athletic recreational facilities and construct new facilities.

Senators hope money will go toward building a new recreational center or new recreational field in the The Village at USC, which is slated to be completed in 2019.

In January, more than 1,600 students signed a petition that called for more funds to be allocated to the Lyon Center and Recreational Sports. Greek Senator Logan Heley, one of the senators who sponsored the resolution, said these increased funds would allow for new athletic facilities to be built.

?We?re calling on the university to use the new University Village project to build a new recreation center and new field dedicated to recreation that will adequately accommodate the student body,? Heley said. ?It?s time for USC to reassess the resources it allocates to student recreation to keep pace and stay ahead of other innovative universities.?

USG Director of Wellness Affairs Wiley Strahan and USG Assistant Director of Wellness Affairs A.J. Pinto authored the resolution. Strahan and Pinto collected the petition signatures and began working on a resolution to allocate more funds for students? needs.

In the USG priority survey, which polled more than 500 students, the majority of students stressed the Lyon Center as their first priority for change on campus. Strahan said the resolution will be a much needed call for improvement.

?I have found that the areas in most disrepair are the places students spend most of their time, such as the Lyon Center, which is why I have been determined to get a resolution regarding student needs through the Senate,? Strahan said.

Those needs, according to the resolution, have drastically changed since the construction of the Lyon Center in 1989. At that time, nearly half of all undergraduates commuted and 90 percent of graduate students were commuters. Today, more students live on or near the campus compared to when the center was originally built.

?The Lyon Center was made when there was a significantly smaller amount of students living on campus,? Pinto said. ?As USC increasingly becomes more of a residential college, the center has become increasingly outdated, and we must build a new center that accommodates the current student body.?

Pinto said there is no effective way to improve the current center; thus, the new project is crucial to solving the perceived problems of the Lyon Center and Recreational Sports on campus.

Furthermore, the fields on campus currently used for recreational sports are primarily devoted to the needs of the varsity and club athletes, often leaving other students without any facility to use. The resolution argues that a new space will alleviate stress and increase wellness among students.

USG also requests a meeting with university administrators, including Provost and Senior Vice President for Academic Affairs Elizabeth Garrett, Vice President for Real Estate Development and Asset Management Kristina Raspe and Senior Associate Director of Recreational Sports Justine Gilman.

Though the resolution only calls for a meeting, the authors want administrators to take action based on the requests of surveyed students.

?We?re really hoping that administrators will recognize the needs of our campus and will try harder to adequately accommodate those needs,? Pinto said.

For the very first time, two spacecraft will fly in formation with millimeter precision

Apr. 16, 2013 ? Spanish industry is leading the Proba-3 mission, a world first in precise formation flying. This European Space Agency (ESA) project aims to demonstrate that two satellites can move as one single object with sub-millimetre precision. This configuration will enable the creation of enormous space telescopes with the lens and detector hundreds of metres apart.

"Proba-3 will be the first mission in which two spacecraft will fly through space as a single unit, pointing at selectable directions, and with sub-millimetre precision, in other words, relative position accuracy to within less than one millimetre," Salvador Llorente, director of this project in SENER, the first Spanish company to lead an ESA mission, explained. There have been very few formation satellite missions up to now, such as the Swedish Prisma project, and only in the near Earth environment and with a level of precision of tens of centimetres.

The new mission includes two satellites weighing approximately 340 kg and 200 kg. They will be launched in 2017 -several launchers are being evaluated, including one from India and another from the US- and they will travel jointly attached together until they separate in a highly-eccentric orbit. Their nearest point, the perigee, will only be 600 km from Earth. Every time they pass through this zone they will be in free flight, but under well controlled trajectories.

The operations associated with precise formation flight will take place on the most distant section of the orbit, the apogee, over 60,000 km away, as here the gravitational disturbances are minimised and do not complicate or make the manoeuvres too costly. The formation technology will be tested and the planned tests will be conducted in this region of the orbit.

One of the relevant experiments including scientific application of Proba-3 will be blocking out the Sun with one of the craft in such a way that the other, 150 m away, can examine the Sun's corona in unprecedented detail.

The first satellite, the blocker, will create an artificial solar eclipse in order to facilitate its companion satellite, the coronograh, in gathering the data. A similar technique was already tried in 1975 on the Apollo-Soyuz mission.

"In any case, the primary objective of this mission is to validate the precision formation flight technology, and to be able to position both craft between 20 and 250 metres apart, yet always working together as if they formed a rigid structure," Llorente emphasised.

The researcher highlighted one possible application of this configuration: "If you wanted to build telescopes with long focal length, you could mount the lens on one of the satellites and the detector on the other, which was already proposed -for instance- in the case of the Xeus x-ray telescope." In this way you can avoid the need for large deployable structures and reduce the mass of the launch, apart from improving the position stability when compared with thermo-elastic distortion with such a large structure. .

Proba-3 will also serve to validate several optical and laser sensors in addition to the algorithms required for future formation flight missions. Different experiments will be used to confirm that this system works properly, varying the distances between the satellites and their pointing direction.

Rendezvous tests, orbital approach manoeuvres between spacecraft in highly elliptical orbit, will also be performed and could be applied to missions to Mars. Specifically in the mission known as 'Mars Sample Return', which plans to pass a Martian rock from one craft to another.

In addition, researchers will test prevention and emergency systems with the activation of engines and other devices to avoid the risk of the satellites colliding, "a situation that entails the premature end to any mission," Llorente warned.

Although the ESA has entrusted SENER with the task of leading the project, other major partners taking part are Astrium CASA Espacio and GMV from Spain, as well as QinetiQ Space and Spacebel from Belgium. The mission's tracking station will be located in the Redu locality (Belgium), although adjustments between the two spacecraft can be programmed automatically.

The details of Proba-3 have been presented in journals such as 'Acta Astronautica' and at conferences such as the International Workshop on Satellite Constellation and Formation Flying (IWSCFF), held recently in Lisbon (Portugal). Researchers and companies from over a dozen countries are taking part in this third PRoject for On-Board Autonomy (PROBA), the ESA's advanced series of technology demonstration mini-satellites.

Tesco quits U.S. as profits fall for first time in 20 years

LONDON (Reuters) - Tesco, Britain's biggest retailer, confirmed it will exit its loss-making business in the United States, taking a 1 billion pound ($1.53 billion) write-off that knocked its year profit down for the first time in two decades.

The group also wrote down the value of its property in Britain, by 804 million pounds, and took a write-down on its businesses in Poland, Czech Republic and Turkey of half a billion pounds.

The raft of announcements form part of Tesco's fightback following a tough period for what was once one of Britain's most consistently performing companies. Its full year results also showed that growth in its core home market had slowed.

"The announcements made today are natural consequences of the strategic changes we first began over a year ago and which conclude today," Chief Executive Philip Clarke said.

The world's third-largest stores group said on Wednesday it made a pretax profit of 1.96 billion pounds in the year to February 13, down 51.5 percent.

It also reported a 14.5 percent fall in underlying full-year profit, largely reflecting the cost of a turnaround plan for its home market, launched after a shock profit warning in January last year.

Despite heavy investment, the group said fourth quarter sales at British stores open over a year, excluding fuel and VAT sales tax, grew 0.5 percent - a slowdown from growth of 1.8 percent in the six weeks to January 5.

Tesco's 1 billion pound fightback plan for Britain focused on more staff, refurbished stores, revamped food ranges and price initiatives - all aimed at reversing years of underinvestment and halting a loss of market share to rivals like J Sainsbury and Asda.

Earnings have also been hit by the impact of the euro zone debt crisis on eastern European markets, restrictions on store opening times in South Korea, and losses at the U.S. business Fresh & Easy.

In the U.S., it has decided to exit altogether.

Fresh & Easy, which trades from 199 stores and employs around 5,000, has absorbed over 1 billion pounds of capital since its 2007 launch when Tesco was run by Clarke's predecessor Terry Leahy but has never turned a profit in a market where it competes with the likes of Trader Joe's, Whole Foods Market and Wal-Mart

Clarke put the venture, which contributes just 1 percent of group turnover, under review in December, saying an exit was likely.

The group made an underlying pretax profit of 3.55 billion pounds. That compares to analysts' consensus forecast of 3.50 billion pounds, according to a company poll, and with 3.92 billion pounds made in the 2011/12 year.

However, he has asserted that they still need to make some essential developments in their car so as to improve its race pace in order to compete well with their major opponents, Ferraris and Lotuses. Besides, he expressed that they earnestly need to improve their tyre management to attain better results in the forthcoming races.

?Of course I would loved to have won and I never like going backwards, but we just don't have the pace of the Ferraris and the Lotuses in race conditions,? (AP) ? Clay Buchholz didn't allow a hit until Kelly Johnson's broken-bat single leading off the eighth inning, and the Boston Red Sox beat the Tampa Bay Rays 5-0 on Sunday.

Buchholz, who threw a no-hitter in just his second career start in 2007, allowed two hits and four walks in eight innings and struck out a career-high 11.

Johnson singled with an 0-1 count on Buchholz's 101st pitch, sending the ball over first baseman Mike Napoli while the top part of the bat landed near the front edge of the infield between first and second. Buchholz induced Sam Fuld to ground into a double play and then allowed Desmond Jennings' double off the left-field wall. Ben Zobrist flied out to left fielder Jackie Bradley Jr.

Buchholz (3-0) lowered his ERA to 0.41, allowing one earned run in 22 innings He left after 109 pitches, and Andrew Miller finished with a one-hit ninth.

Buchholz's performance came one day after the Mets' Matt Harvey pitched 6 2-3 innings at Minnesota before Justin Morneau homered off the right-field foul pole in New York's 4-2 win.

Alex Cobb (1-1) allowed four runs ? three earned ? and seven hits in 6 2-3 innings, and Tampa Bay lost for the fifth time in six games. The Rays have eight runs in their last six games, including four in their last four, and are batting .212 this season.

Boston took a 4-0 lead in the third. Mike Napoli hit a two-run double to deep right-center and a Stephen Drew hit into a run-scoring, bases-loaded forceout. After first baseman James Loney threw to second, shortstop Yunel Escobar threw wildly past Loney trying for a double play, and Daniel Nava scored from second as the ball wound up in Boston's dugout for an error.

Court: Can human genes be patented?

WASHINGTON (AP) ? DNA may be the building block of life, but can something taken from it also be the building block of a multimillion-dollar medical monopoly?

The Supreme Court grapples Monday with the question of whether human genes can be patented. Its ultimate answer could reshape U.S. medical research, the fight against diseases like breast and ovarian cancer and the multi-billion dollar medical and biotechnology business.

"The intellectual framework that comes out of the decision could have a significant impact on other patents ? for antibiotics, vaccines, hormones, stem cells and diagnostics on infectious microbes that are found in nature," Robert Cook-Deegan, director for genome ethics, law & policy at Duke University, said in a statement.

"This could affect agricultural biotechnology, environmental biotechnology, green-tech, the use of organisms to produce alternative fuels and other applications," he said.

The nine justices' decision will also have a profound effect on American business, with billions of dollars of investment and years of research on the line. The U.S. Patent and Trademark Office has been awarding patents on human genes for almost 30 years.

And Myriad Genetics alone has $500 million invested in the patents being argued over in this case. Without the ability to recoup that investment, breakthrough scientific discoveries needed to combat all kind of medical maladies wouldn't happen, the company says.

"Countless companies and investors have risked billions of dollars to research and develop scientific advances under the promise of strong patent protection," said Peter D. Meldrum, the president and CEO of Myriad Genetics, in a statement.

But their opponents argue that allowing companies like Myriad to patent human genes or parts of human genes will slow down or cripple lifesaving medical research like in the battle against breast cancer.

"What that means is that no other researcher or doctor can develop an additional test, therapy or conduct research on these genes," said Karuna Jagger, executive director of Breast Cancer Action.

The Supreme Court has already said that abstract ideas, natural phenomena and laws of nature cannot be given a patent, which gives an inventor the right to prevent others from making, using or selling a novel device, process or application.

Myriad's case involves patents on two genes linked to increased risk of breast and ovarian cancer. Myriad's BRACAnalysis test looks for mutations on the breast cancer predisposition gene, or BRCA. Those mutations are associated with much greater risks of breast and ovarian cancer.

Women with a faulty gene have a three to seven times greater risk of developing breast cancer and a higher risk of ovarian cancer. Men can also carry a BRCA mutation, raising their risk of prostate, pancreatic and other types of cancer. The mutations are most common in people of eastern European Jewish descent.

Myriad sells the only BRCA gene test.

The American Civil Liberties Union challenged Myriad's patents, arguing that genes couldn't be patented, and in March 2010 a New York district court agreed. But the U.S. Court of Appeals for the Federal Circuit has now twice ruled that genes can be patented. In Myriad's case, it's because the isolated DNA has a "markedly different chemical structure" from DNA within the body.

Mark C. Capone, president of Myriad Genetics Laboratories, Inc., a subsidiary of Myriad, said some of the concerns over what they have patented are overblown and some simply incorrect.

"Myriad cannot, should not and has not patented genes as they exist in the human body on DNA," Capone said in an interview. "This case is truly about isolated DNA molecules which are synthetic chemicals created by the human ingenuity of man that have very important clinical utilities, which is why this was eligible for a patent."

But the ACLU is arguing that isolating the DNA molecules doesn't stop them from being DNA molecules, which they say aren't patentable.

"Under this theory, Hans Dehmelt, who won the Nobel Prize for being the first to isolate a single electron from an atom, could have patented the electron itself," said Christopher A. Hansen, the ACLU's lawyer in court papers. "A kidney removed from the body (or gold extracted from a stream) would be patentable subject matter."

The Obama administration seems to agree. Artificially created DNA can be patented, but "isolated but otherwise unmodified genomic DNA is not patent-eligible," Solicitor General Donald Verrilli said in court papers.

That was the ruling of the original judge who looked at Myriad's patents after they were challenged by the ACLU in 2009. U.S. District Judge Robert Sweet said he invalidated the patents because DNA's existence in an isolated form does not alter the fundamental quality of DNA as it exists in the body or the information it encodes. But the federal appeals court reversed him in 2011, saying Myriad's genes can be patented because the isolated DNA has a "markedly different chemical structure" from DNA within the body.

The Supreme Court threw out that decision and sent the case back to the lower courts for rehearing. This came after the high court unanimously threw out patents on a Prometheus Laboratories, Inc., test that could help doctors set drug doses for autoimmune diseases like Crohn's disease, saying the laws of nature are unpatentable.

But the federal circuit upheld Myriad's patents again in August, leading to the current review. The court will rule before the end of the summer.

"The key issue now for the court will therefore be whether the scientist working in the lab to isolate a particular gene innovated in a way that allows for that isolated gene to be patented," said Bruce Wexler, a lawyer with the law firm Paul Hastings, who advises pharmaceutical and biotech companies on patent issues.

Woods story, predictably, dominates CBS broadcast

CBS announcer Jim Nantz led off the network's Masters coverage Saturday by describing what Tiger Woods did the day before on the 15th hole as an "innocent" and "absent-minded" mistake.

CBS devoted the first 12 minutes of its broadcast from the Masters entirely to Woods, who was given a two-stroke penalty earlier in the day for a bad drop that led to his signing an incorrect scorecard after his second round.

Woods' shot on the 15th hole of the second round hit the flag stick and bounced back into the water. He took his penalty drop 2 yards behind where he hit the original shot, a rules violation.

Woods was tied for 17th when the third-round broadcast started at 3 p.m. EDT, five shots off the lead. His story dominated the early coverage, and CBS didn't mention another player until 3:12 p.m.

Sen. Rubio says immigration deal needs tough terms

WASHINGTON (AP) ? A bipartisan deal on immigration legislation would need tough enforcement and even stricter penalties for those who came to the United States illegally, a leading Republican at the center of negotiations said Sunday.

Sen. Marco Rubio, who's among the eight senators writing a plan that's expected to come out Tuesday, tried to promote the framework for the emerging overhaul that would provide a path toward citizenship for those who came to the country illegally or overstayed their visit.

While the deal does include a long and difficult process for the 11 million individuals in question, Rubio insisted the proposal does not include an "amnesty" provision that fellow conservatives have called a deal-breaker.

"We're not awarding anybody anything. All we're doing is giving people the opportunity to eventually earn access to our new, improved and modernized legal immigration system," said Rubio, a Florida Republican and Cuban-American.

But even among his fellow Republicans, there are serious doubts.

"I'm not convinced," said Sen. Jeff Sessions, R-Ala. "I know Sen. Rubio's heart is exactly right. And I really respect the work of the 'Gang of Eight.' But they have produced legislation ... that will give amnesty now, legalize everyone that's here effectively today and then there's a promise of enforcement in the future."

Rubio said he would abandon the overhaul effort if enforcement, border security and other elements are softened to his dissatisfaction.

With an eye on a possible White House run in 2016, Rubio has been careful not to appear weak on border security or create political problems among the conservatives who have great sway in picking the GOP's nominee.

Rubio also told those immigrants that it would perhaps be easier if they returned to their home countries and started the process from scratch rather than use the process Rubio is proposing.

"So I would argue that the existing law is actually more lenient, that going back and waiting 10 years is going to be cheaper and faster that going through this process that we are outlining," he said.

Other lawmakers helping to write the legislation acknowledged the political challenges of the issue.

"A lot of my conservative colleagues have significant questions and they're legitimate," said Sen. John McCain, R-Ariz. "This is the start of a process, this is a vehicle that requires hearings, requires input and we welcome all of that. ... I am guardedly optimistic that we will see finally the end of this long, long trek that a lot of us have been on for many years."

The measure would put millions who are in the U.S. illegally on a 13-year path to citizenship, while toughening border security requirements, mandating that all employers check the legal status of workers, and allowing tens of thousands of new high- and low-skilled workers into the country with new visa programs.

The legislation is expected to include a new emphasis on merit-based immigration over family ties.

"This is a very balanced bill. The American people have told us to do two things: one, prevent future flows of illegal immigration; and then, come up with a common-sense solution for legal immigration. And that's what our bill does," said Sen. Chuck Schumer, D-N.Y.

All of this, however, is contingent on the border security and enforcement, Rubio said.

"If you are undocumented here now, if you are illegally in the U.S., that you can't even apply for this until these plans are in place and they begin to implement them," Rubio said. "And then you're going to have to pay a fine. You're going to have to pay an application fee. You're going to have to pass a background check."

Without those pieces, the path to citizenship is unavailable, and the proposal is available only for those who arrived in the United States before Dec. 31, 2011. Anyone who came after that date would be subject to deportation.

Rubio pressed his case during interviews on ABC's "This Week," CBS' "Face the Nation," CNN's "State of the Union", "Fox News Sunday" and NBC's "Meet the Press." He also was booked on the Spanish-language networks Telemundo and Univision. Sessions and Schumer were on ABC while McCain appeared on CNN.

Google's New Inactive Account Manager Gives You Control Over Your Digital Afterlife

That’s probably not something you really want to think about, but as more and more of our data now lives online, that’s sadly a question that comes up with some regularity. Today, Google is launching its Inactive Account Manager on the Google Account settings page, which sets out to set up a system that allows you to tell Google “what you want done with your digital assets when you die or can no longer use your account.” With the Inactive Account Manager, you can set up a very straightforward procedure for what should happen to your data after your account becomes inactive “for any reason.” First, you set up a timeout period (three, six, nine or twelve months of inactivity). After that, you can either have all of your data deleted, or you can select a number of trusted contact who can receive your data from a set of Google services. Currently, you can choose to send your data from Blogger, Contacts and Circles, Drive, Gmail, Google+ Profiles, Pages and Streams, Picasa Web Albums, Google Voice and YouTube, as well as your +1s from across the web to whoever you choose to receive it after your timeout period. This doesn’t mean people will be able to send email from your accounts – they are not getting your passwords, after all. Just your data. Of course, Google will first try to contact you by email (to your secondary address) and text message to ensure that you are really dead and didn’t just switch to Bing and Outlook.com. This system opens up an interesting question: what happens when you have told the system to delete all of your data and there is a family member or other interested party who wants access to your account? A Google spokesperson told us that “when there?s a conflict, we will honor the preference you?ve made in Inactive Account Manager to the extent permitted by law.” Other online services have different ways of dealing with this situation. Facebook, for example, says it can’t provide others with the login information for a deceased user’s account, but it does have a procedure in place for “memorializing” accounts. Twitter has a slightly more complicated system that’s more akin to how Gmail used to handle the accounts of deceased users and which involves sending copies

S&P hits new high in broad rally, Wall Street up 1 percent

NEW YORK (Reuters) - The S&P 500 rose to a historic high on Wednesday as stocks advanced 1 percent in a broad rally, with technology shares among the strongest of the day.

For the second day in a row, cyclical shares advanced as investors bought into the sector, which has lagged other sectors recently. As these groups are closely tied to the pace of economic growth, many investors viewed the advance as a sign that the rally has staying power.

The S&P 500 broke past its previous all-time intraday high of 1,576.09, which was set on October 11, 2007, rising as high as 1,587.80. The Dow hit yet another intraday milestone, rising as high as 14,817.06.

"The path of least resistance for the market remains higher, and despite some mixed economic data, investors are concluding that stocks remain a better place to be than risk-free assets," said Jim McDonald, chief investment strategist at Chicago-based Northern Trust Global Investments, which has about $760 billion in assets under management.

Gains were broad, with all but two of the S&P's 10 primary sectors up more than 1 percent. About three-fourths of stocks traded on both the New York Stock Exchange and Nasdaq were higher on the day.

Tech was the day's strongest group, with the S&P technology sector <.splrct> up 1.8 percent. The group was lifted by strong results at Adtran Inc , which jumped 12.6 percent to $22.19 and boosted peer companies. JDS Uniphase Corp added 5.7 percent to $14.11 while Juniper Networks Inc rose 5.4 percent to $18.97.

Also boosting the sector was Facebook Inc , which jumped 4.4 percent to $27.77.

The Dow Jones industrial average <.dji> was up 138.49 points, or 0.94 percent, at 14,811.95. The Standard & Poor's 500 Index <.spx> was up 18.53 points, or 1.18 percent, at 1,587.14. The Nasdaq Composite Index <.ixic> was up 56.74 points, or 1.75 percent, at 3,294.60.

With the gains, the S&P is now up 11.3 percent on the year while the Dow is up 13 percent.

The Federal Reserve unexpectedly released the minutes from its most recent policy-setting meeting five hours early. The minutes showed a few policymakers expected to taper the pace of asset purchases by mid-year and end them later this year, while several others expected to slow the pace a bit later and halt the quantitative easing program by year-end.

Accommodative monetary policy from the Fed has been credited with helping to boost equity prices, and uncertainty surrounding the minutes briefly hit indexes in the premarket session, though they subsequently recovered.

"The only way quantitative easing will be tapered off is if the labor market shows noticeable improvement, and the most recent data doesn't show that," said McDonald, referring to the March payroll report, which was sharply under expectations.

"QE will only be taken away when we're in a self-sustaining recovery. We're not there yet, which points to the Fed continuing to stimulate the economy."

Among the 5 percent of S&P 500 companies that have reported results so far, almost three-quarters have topped expectations, according to Thomson Reuters data.

But quarterly profits are expected to grow just 1.5 percent from a year ago, down from a January estimate of 4.3 percent. The lowered expectations could make it easier for companies to beat analysts' estimates and propel the market further.

Family Dollar Stores reported weaker-than-expected profit on Wednesday. Its stock was up 0.1 percent at $59.87 after falling 2.6 percent to a session low of $58.27 earlier.

Hospital operator Health Management Associates Inc cut its outlook for 2013 earnings and revenue, citing weak patient-admission figures in the first quarter of the year. The stock plummeted 18 percent to $10.27.

Samsung announces 5.8-inch and 6.3-inch Galaxy Mega smartphone

Galaxy MegaAndroid 4.2 and the latest Samsung software on new, larger-than-life devices

After a couple of weeks of rumors, Samsung has today officially confirmed the Galaxy Mega series -- a line of big-screen smartphones aimed to straddle the space between the traditional phone and tablet markets. The official names, as rumored, are Galaxy Mega 5.8 and Galaxy Mega 6.3.

Unlike the popular Galaxy Note series there's no Wacom-based 'S Pen' stylus included. But both Galaxy Mega devices include just about all the Samsung software features of newer Samsung phones like the Galaxy S4, due to the fact that they're running the latest version of the company's TouchWiz UI. That means new features like 'S Travel' and 'Story Album' come included out of the box, alongside the latest version of Google's mobile OS, Android 4.2 Jelly Bean.

A few other differences between the two Megas -- the Galaxy Mega 6.3 boasts LTE connectivity and a 1.7GHz dual-core CPU, while the 5.8-incher runs at 1.4GHz on HSPA+21. The 6.3 also has a higher-resolution screen -- "HD" (presumably 720p) according to today's press release -- as opposed to the 5.8's qHD (960x540). The 5.8-inch model offers a 2600mAh battery, as opposed to the 6.3's 3200mAh juicer. Both devices pack 1.5GB of RAM, an 8-megapixel rear camera and 1.9-megapixel front-facers.

So it the 6.3-inch Galaxy Mega is definitely the higher-end of the two, and you can see that reflected in its design. With its minimal bezel and redesigned silver trim, it's the spitting image of the Galaxy S4, whereas the Mega 5.8 looks closer to the Galaxy S3.

Today's news comes as Samsung faces increasing competition in the large-form-factor smartphone space, including 5-inch-plus devices from the likes of LG, ZTE and Huawei.

Samsung says the Galaxy Mega series will debut in Europe and Russia starting this May. We've got official images and the full press release after the break.

Rivera thanks Indians employees for memories

(AP) ? Before Mariano Rivera answered questions from Indians employees he wanted to personally thank on his last visit to Progressive Field, the greatest closer in history had a request of his own.

"Where's the drummer?" Rivera asked.

He wanted to finally meet the man who has kept a steady sports beat in Cleveland for 40 years, the guy sitting at the top of the bleachers year after year pounding away to spark a rally.

"Right here," John Adams said, raising one of his drum sticks so the New York legend could see him in the back of the room.

"Hey, you the man," Rivera said. "Being loyal, being there day in and day out. I really respect that."

"Thank you," Rivera said.

During his final trip around the majors, Rivera, who is retiring at the end of this, his 19th season with the Yankees, is taking time to visit with team employees who work behind the scenes. On Wednesday, Rivera met with 25 Indians employees ? ushers, ticket salespersons, custodians and others ? for 30 minutes before the Yankees played the Indians.

They came to say goodbye to Rivera, who answered questions, posed for pictures and handed out autographed baseballs to Clevelanders who seemed in awe of the classy gesture.

"I appreciate what you guys do," Rivera said. "We see mostly what goes on when we're on the field and not what's going on behind the scenes. I wanted to say thank you for everything that you guys do, for the love and passion you have for your team. It doesn't matter if you are a Yankee fan or not. You are a baseball fan.

"Thank you for being here. I know you are busy, but thank you for taking a little bit of time. I appreciate that."

With that, Rivera said he was ready for questions and braced himself to be peppered by some Indians die-hards who have watched No. 42 come in and close out comebacks and dash more than a few special seasons in Cleveland.

"You can say whatever you want now," Rivera said with a laugh.

It didn't take long for one of the employees to ask Rivera for his favorite memories in Cleveland. In 1997, Rivera famously gave up a game-tying homer to Sandy Alomar Jr. in the eighth inning of Game 4 of the AL division series. The Indians went on to win and take the series in five games, denying the Yankees a chance to defend their World Series title.

For Rivera, it was a rare moment of failure.

But looking back, the 43-year-old said it provided motivation.

"Let me tell you something, if you think '97 was bad," he said. "For me, it was the stone where I stepped to push forward because it helped me to become better. If that wouldn't have happened, God only knows where I would have ended up. But because that happened, it pushed me to be better in moments like that and in situations like that."

Rivera recalled facing dominant Cleveland teams of the 1990s, when the Indians had one of baseball's most feared lineups with Jim Thome, Manny Ramirez, Kenny Lofton, Omar Vizquel and Albert Belle.

"All those years it was a battle here," said Rivera, who announced on March 9 that this would be his final season. "It was never easy."

Rivera, though, often made it look so. He has 609 career saves, and has converted his last 17 save opportunities against the Indians since 2003.

Rivera recoiled playfully when Adams told him he's been drumming at Indians games since 1973.

"This is stress relief for me," he told Rivera. "And you've given me a lot of stress."

Rivera plans special goodbyes during the remainder of his final season. Last week in Detroit, he met with a longtime member of the grounds crew who worked at Tiger Stadium and Comerica Park. He also visited with other members of the Tigers' extended family, faces not as recognizable as his own but people he feels indebted to.

He told them Edgar Martinez was the toughest hitter he ever faced, and he grew up worshipping Pele, the Brazilian soccer legend.

At the end of the visit inside the Indians' press conference room, Rivera met with each of the employees, taking a moment to talk about their jobs, families, whatever they wanted to say.

Mary Forkapy has worked for the Indians since 1996, handling the team's payroll. She shook hands with Rivera, posed for a picture with his valuable right arm around her shoulder and accepted a baseball with the signature of the future Hall of Famer.

"It was very genuine, very heartfelt, very nice," she said of her one-on-one time with Rivera. "He told me I was a very important person."

So did this soften her hatred toward the Yankees?

"A little," she said.

As the group dwindled to just a few, Rivera shook hands with Adams, who tried to get the reliever to take a whack at his large drum.

"No, I can't," Rivera said. "That's your thing."

NOTES: With Wednesday night's game postponed by rain, the Indians will also delay a ceremony to honor Rivera. The Yankees were only scheduled to play four games in Cleveland, but will have to come back at a future date for the makeup. .... RHP Ivan Nova's turn will be skipped and Phil Hughes will start Thursday for New York. ... The rainout cooled off Robinson Cano, who went 7 for 10 with three doubles, three homers and seven RBIs in the first two games of the series. He has twice had consecutive three extra-base hit games. The only other Yankee to do that was Lou Gehrig in 1936.
